Welcome to Latexelle. These Terms of Service ("Terms") apply to your access to and use of latexelle.com and any related information, content, features, tools, products, and services offered through our online store (collectively, the "Services"). The terms "we", "us", and "our" refer to Vibe Wear LLC, doing business as Latexelle.
Latexelle is powered by Shopify, which enables us to provide the Services to you. Any purchases made through our store are made directly with Vibe Wear LLC d/b/a Latexelle.
By visiting, browsing, using, or purchasing from our Services, you agree to be bound by these Terms, our Privacy Policy, our Refund Policy, and our Shipping Policy. If you do not agree to these Terms, please do not use the Services.
SECTION 1 - ELIGIBILITY, ACCESS, AND ACCOUNT
By using the Services, you represent that you are at least the age of majority in your state, province, or country of residence, or that you are the age of majority and have given consent for any minor dependents to use the Services on devices you own, purchase, or manage.
You may be asked to provide information such as your name, email address, billing address, shipping address, payment information, and order details. You agree that the information you provide is accurate, current, and complete. You are responsible for keeping your account credentials secure and for all activity under your account.
SECTION 2 - OUR PRODUCTS
Latexelle offers premium latex fashion garments, including made-to-order dresses, catsuits, tops, skirts, and related accessories. Many of our products are handmade or made to order, and some items may be produced according to custom measurements, selected colors, or other customer-provided specifications.
We make every reasonable effort to display product descriptions, images, colors, sizing information, prices, and availability accurately. However, product colors and surface appearance may vary depending on screen settings, lighting, photography, and the natural characteristics of latex material.
Latex is a delicate material and requires special handling, cleaning, polishing, storage, and care. Please review the product page and any care instructions provided with your order before use. Damage caused by improper care, sharp objects, oils, lotions, perfumes, heat, sunlight, or other unsuitable handling may not be covered by returns or remedies unless required by law.
We reserve the right to update product descriptions, pricing, availability, images, options, or specifications at any time, provided that such updates do not affect an order already accepted by us except as permitted by these Terms or applicable law.
SECTION 3 - ORDERS AND ORDER ACCEPTANCE
When you place an order, you are making an offer to purchase the selected product or products. We reserve the right to accept, decline, cancel, or limit any order where permitted by law, including where product information, pricing, availability, shipping information, fraud screening, or payment authorization requires review.
Your order is accepted when we confirm acceptance and begin processing the order. For made-to-order or custom items, production may begin after the order is accepted and payment is processed. Please review your order carefully before submitting it, including size, measurements, color, shipping address, and contact information.
If we need to cancel or change an order, we will attempt to contact you using the email address, billing address, shipping address, or phone number provided at checkout.
Your purchases are subject to our Refund Policy. Return, exchange, cancellation, and refund eligibility may vary depending on whether the item is standard size, custom measurement, custom color, personalized, final sale, damaged, defective, or incorrectly shipped.
You agree that purchases are for your personal or household use and not for unauthorized commercial resale, export, or distribution.
SECTION 4 - PRICES, PAYMENT, TAXES, AND CUSTOMS
Prices, discounts, and promotions are subject to change without notice. The price charged for an item will be the price shown at the time your order is placed and confirmed in your order confirmation email.
Unless expressly stated otherwise, posted prices do not include shipping fees, handling fees, customs duties, import taxes, VAT, or other government charges. Shipping costs and available shipping options may be shown at checkout.
International orders may be subject to customs duties, import taxes, VAT, brokerage fees, or similar charges imposed by the destination country. These charges are not included in our product prices or shipping fees unless expressly stated and are the responsibility of the customer.
You agree to provide current, complete, and accurate purchase, payment, billing, and account information for all purchases. You represent that you are authorized to use the payment method provided and that all charges incurred by you will be honored by your payment provider.
SECTION 5 - SHIPPING, PRODUCTION, AND DELIVERY
Our shipping terms are described in our Shipping Policy, which forms part of these Terms.
Many Latexelle products are made to order. Product pages may state an estimated production time, such as "ready in 4 weeks", before dispatch. Delivery estimates begin after production is complete and the package has been handed to the carrier.
Where available, Express Shipping may be offered for a flat fee of $49.99 USD. Estimated express delivery time is 4-8 business days after dispatch. Express Shipping does not shorten the made-to-order production time.
Estimated delivery times are not guarantees. Delivery may be affected by production volume, material availability, carrier delays, customs processing, local postal conditions, incorrect shipping information, holidays, weather, or events outside our reasonable control.
Once your order ships, we will provide tracking information when available. Tracking information may take time to update after dispatch. Please contact us promptly at support@latexelle.com if your shipping address needs correction. We are not responsible for delays or losses caused by incorrect or incomplete addresses provided by the customer.
SECTION 6 - RETURNS, EXCHANGES, AND REFUNDS
Returns, exchanges, cancellations, and refunds are governed by our Refund Policy. Please review that policy before placing an order.
Because many Latexelle items are made to order, custom measurement items, custom color items, personalized items, worn items, used items, damaged items caused by improper handling, and certain final sale items may not be eligible for return unless the product is defective, damaged upon receipt, incorrectly shipped, or return rights are required by applicable law.
If your item arrives defective, damaged, or incorrect, please contact us promptly at support@latexelle.com with your order number and clear photos so we can review the issue and help resolve it.
SECTION 7 - INTELLECTUAL PROPERTY
The Services, including trademarks, brand names, product names, product designs, logos, text, images, graphics, video, audio, layout, and other content, are owned by Vibe Wear LLC d/b/a Latexelle, our affiliates, or our licensors, unless otherwise stated, and are protected by intellectual property laws.
You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, modify, distribute, publish, display, sell, resell, scrape, download, transmit, or exploit any part of the Services without our prior written permission, except as permitted by applicable law.
Latexelle names, logos, product names, designs, and slogans are trademarks or trade dress of Latexelle or its affiliates or licensors. Shopify names and logos are trademarks of Shopify. Other names, logos, and trademarks belong to their respective owners.
SECTION 8 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES
We may provide access to tools, applications, payment services, checkout services, shipping services, analytics, marketing tools, or other services offered by third parties. These third-party services may be subject to their own terms and privacy policies.
We provide access to third-party tools "as is" and "as available" without warranties, representations, or conditions of any kind, except as required by law. Your use of any third-party tools is at your own risk and discretion.
SECTION 9 - THIRD-PARTY LINKS
The Services may contain links to third-party websites or materials. We are not responsible for the content, accuracy, policies, practices, or services of any third-party websites. If you access third-party websites, you do so at your own risk.
Complaints, claims, concerns, or questions regarding third-party products or services should be directed to the applicable third party.
SECTION 10 - RELATIONSHIP WITH SHOPIFY
Latexelle is powered by Shopify, which enables us to provide the Services. However, any sales and purchases made through our store are made directly with Vibe Wear LLC d/b/a Latexelle. Shopify is not responsible for any aspect of sales between you and Latexelle, including any injury, damage, or loss resulting from products or services purchased from us, except as required by applicable law.
SECTION 11 - PRIVACY
Our collection, use, disclosure, and processing of personal information is described in our Privacy Policy. Because our Services are hosted by Shopify, Shopify may also collect and process personal information in connection with your access to and use of the Services.
By using the Services, you acknowledge that you have reviewed our Privacy Policy.
SECTION 12 - FEEDBACK, REVIEWS, AND USER CONTENT
If you submit, upload, post, email, or otherwise provide ideas, suggestions, reviews, photos, comments, proposals, or other content ("Feedback"), you grant us a worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works from such Feedback for purposes related to operating, improving, and promoting the Services, subject to applicable law.
You represent that you own or have the necessary rights to submit the Feedback and that your Feedback does not violate the rights of any third party. You may not submit unlawful, abusive, defamatory, obscene, misleading, infringing, or malicious content, or content containing viruses or malware.
We may, but are not obligated to, monitor, edit, or remove Feedback that we determine violates these Terms or applicable law.

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, availability, or other information.
We reserve the right to correct errors, inaccuracies, or omissions and to change or update information or cancel orders if information is inaccurate, including after an order has been submitted, where permitted by applicable law.

You may use the Services only for lawful purposes. You may not use the Services to violate any law or regulation, infringe intellectual property or privacy rights, transmit false or misleading information, harass or harm others, impersonate another person or entity, transmit viruses or malicious code, interfere with the operation or security of the Services, scrape or extract data without permission, or use the Services in a way that could harm Latexelle, Shopify, other users, or third parties.
We may suspend, restrict, or terminate access to the Services if we believe you have violated these Terms or applicable law.
SECTION 15 - TERMINATION
We may terminate these Terms or your access to the Services at any time where permitted by law. You remain responsible for all amounts due up to and including the date of termination.
Sections that by their nature should survive termination will continue to apply, including sections relating to intellectual property, feedback, disclaimers, limitation of liability, indemnification, governing law, privacy, and payment obligations.
SECTION 16 - DISCLAIMER OF WARRANTIES
The Services and products are provided "as is" and "as available" except as expressly stated by Latexelle or required by applicable law. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.
To the fullest extent permitted by law, we disclaim all warranties, representations, and conditions, whether express or implied, including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. Some jurisdictions do not allow limitations on certain warranties, so some limitations may not apply to you.
Nothing in these Terms limits any rights you may have under applicable consumer protection laws.
SECTION 17 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, Vibe Wear LLC d/b/a Latexelle, our affiliates, partners, directors, officers, employees, agents, contractors, service providers, and licensors will not be liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages arising from your use of the Services or products purchased through the Services.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
SECTION 18 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Vibe Wear LLC d/b/a Latexelle, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, claims, and reasonable attorneys' fees arising out of your breach of these Terms, your violation of applicable law, your violation of third-party rights, or your misuse of the Services.
SECTION 19 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion will be deemed severed from these Terms. The remaining provisions will remain in full force and effect.

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms and any policies posted by us on the Services constitute the entire agreement between you and us regarding your use of the Services and supersede any prior or contemporaneous agreements, communications, and proposals between you and us.
SECTION 21 - ASSIGNMENT
You may not transfer, assign, or delegate these Terms or any rights or obligations under these Terms without our prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations where permitted by law.
SECTION 22 - GOVERNING LAW
These Terms and any separate agreements by which we provide the Services are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles, except where applicable consumer protection laws require otherwise.
Where permitted by law, you and Vibe Wear LLC d/b/a Latexelle consent to the venue and personal jurisdiction of the state and federal courts located in Wyoming, United States.
SECTION 23 - CHANGES TO THESE TERMS
You can review the most current version of these Terms on this page at any time. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. Changes will be effective when posted unless a later date is stated.
Your continued use of the Services after changes are posted constitutes acceptance of those changes, except where additional notice or consent is required by law.
